Terms and Conditions (“Terms and Conditions”)

Version: January 2024

This document tells you everything you need to know about your contract with One Part Love Bakery. We encourage you to read the Agreement carefully. It is your responsibility to check all details in the invoice are complete and accurate as this is the document we work to when completing your order.

Nothing contained within these Terms and Conditions affects your statutory rights as a consumer. If there is anything you don’t understand please feel free to contact us.

Please be aware that by paying your deposit you are accepting these terms and conditions.

It is important that you read carefully section 7 regarding food allergies and intolerances.

  1. Your Agreement with One Part Love Bakery

    • 1.1. This agreement covers your purchase of a Wedding Cake, Celebration Cake and/or Sweet Treats (referred to in these Terms and Conditions as “Event Cake”) and the applicable delivery service for your event.

    • 1.2. Who we are: We are One Part Love Bakery registered in England under number 10546325 at The Office Arbor Grange, Babraham Road, Cambridge, Cambridgeshire, CB22 3AY (“One Part Love Bakery” or “Us” or “We”).

    • 1.3. The Agreement: Your contract with One Part Love Bakery is made up of these Terms and Conditions, your Order, [final quote] and corresponding invoices (together, referred to as the “Agreement”).

    • 1.4. When do we enter into the Agreement? The Agreement is entered into between our customer (“You” or “Customer”) and One Part Love Bakery upon receipt of the deposit/booking fee (as explained in section 2 below). At this stage You have entered into a legally binding contract with Us for the supply of your Event Cake.

  2. Consultation, Booking Fee and Securing your Event Date

    • 2.1.Your Consultation: We will arrange a consultation with You to discuss your Event Cake. We may provide or show you samples, drawings/illustrations or descriptions of our work. These are shared with you for the sole purpose of providing you with an understanding of our portfolio or work and possible inspiration for your cake design with Us (“Our Work”). Our Work remains the property of One Part Love Bakery. As of March 2021, I will no longer be including face to face consultations and taster sessions as mandatory, the majority of orders can be dealt with via email or by arranging an online chat.

    • 2.2. Cake Tasters: Optional cake tasters will be offered to all booked couples and will be posted, unless you are local to CB21 postcode in which case you are welcome to collect them at a prearranged time. They will be available at selected dates throughout the year and couples will be contacted to arrange this. They are charged at £35 + £8.95 for next day delivery. Tasters will not be made on request. Tasters include a choice of 6 different flavours and will be packaged in a way that is suitable for posting. (Please see section 7 regarding allergies).

    • 2.3. Your Cake Design: If One Part Love Ltd decides a sketch of your cake design is vital to the process, this will be drawn up at our discretion. This sketch and design remains our property until the deposit has been paid, after that we will send a copy of the design to you. This design is covered by Copy Write law.

    • 2.4. Your Quote: Following our initial correspondence and subject to availability of your event date, you will be issued with a quote for the Event Cake (the “Quote”). Your Quote is valid for a period of 30 calendar days from the date of issue. You can find the date of issue on your Quote. After this point, we have the right to recalculated based on our current prices.

    • 2.5. How to secure your event date: In order to secure your event date, we require receipt of the full non-refundable booking fee (“Booking Fee”) within 7 days of the invoice being sent. Dates cannot be held open without a deposit. You can find your Booking Fee stated in the Quote provided to You by Us following the consultation. You deposit is non refundable and non transferrable.

    • 2.6. Final Payment: All balances are due 4 weeks before your event. We are not required to send out reminders (although often do), so please make a note of your final payment date in advance. Payments are not permitted to be made in instalments. If this payment is not received 20 days before your event, we have the right to cancel your booking. The deposit is non refundable and non transferable. (Please also see section 5

  3. Your Event Cake

    3.1. Design and Appearance

      • 3.1.1.What can I expect of my Event Cake design? Your Event Cake will materially confirm to their description as set out in the invoice, be of satisfactory quality and comply with all food safety, statutory and regulatory requirements in the UK.

      • 3.1.2.Will my Event Cake be an exact replica of a particular design, photo or colour swatch? We cannot guarantee an exact replica of any cake but we will do our best to make it so. Where colour swatches are provided we will do our best to match as close as we deem possible. Exact colour matches are not guaranteed.

      • 3.1.3. Checking the proposed Event Cake design: It is Your responsibility to ensure all details within the invoice and the corresponding Event Cake sketch are correct and meet your exact requirements. Please ensure you do this prior to paying the Booking Fee.

      • 3.1.4. Cake Finish: All cakes are finished in white chocolate ganache which is a mixture of white chocolate and cream as it withstands warmer temperatures and being sat out on display for longer periods of time. Between each layer is American or Swiss Meringue Buttercream (flavour dependant). Unless specifically stated in your invoice, all cakes will be finished in ganache.

      • 3.1.5. Cake Sizes & Portions: All my cake sizes are calculated based on finger portions which are 1” x 2” x 1/2 the height of your cake (approx. 6-7” deep as standard). You are more than welcome to opt for larger dessert portions (1” x 2” x full height of the cake) but please bae in mind that this will be a much larger cake and the cost will reflect this.

      • 3.1.6. Interpretation of Customer Instructions: You agree that We will not be held responsible for Customer disappointment relating to Event Cake design or the interpretation of the Event Cake as long as it is made in line with the Customer’s pre agreed requirements set out in the invoice and sketch and We will face no consequent liability.

        3.2 Hire of Cake Stands and Decorative Props

      • 3.2.1.Do you provide the cake stand? Subject to availability, You can arrange to hire one of the One Part Love Bakery cake stands for your event day (“Cake Stands”).

      • 3.2.2.What is the price of hiring a Cake Stand? The price of hiring a Cake Stand is a refundable  £100.00 (or as otherwise agreed). This will amount be refunded to you on return of the cake stand to our bakery. This is not included in your Event Cake price and must be requested at the time of booking to ensure availability for your event.

      • 3.2.3.Returning Cake Stands:  The Cake Stand stand must be returned to us within 4 days of your event (“Return Period”) in the same condition that we loan it to You. If it is not returned within the Return Period, You will be invoiced for the full cost of the replacement.

      • 3.2.4. We do not collect any stands unless previous agreed. If a cake stand is left at a venue and we  are asked to collect it, we will charge a full delivery price there and back for collection which is subject to our discretion.

      • 3.2.5.Damage to cake stands: Please notify us as soon as you can if damage or breakage has occurred so we can assess the situation and advise of the best resolution. If the item is damaged beyond repair then the deposit will be forfeited. If the item can be repaired e.g. by obtaining a new part then only the cost of this new part plus an admin fee of £10 will be charged.

      • 3.2.6.Providing your own cake stand: We request that you advise us of any stands that you wish to provide yourself for the cake to sit on so we can check if we think it will be stable enough to take the weight of a wedding or event cake. We only use certain cake stands which have been professionally weight tested so we can be confident that the stand will hold the weight of the cake.

    • 3.3.Materials

      1. 3.3.1.From time to time, certain materials for our cakes may become obsolete and/or unavailable. You acknowledge that this is totally out of our control; however we will do our best to select replacement products to reflect the original design as closely as possible.

      2. 3.3.2.We reserve the right to replace items with component parts of equal or better quality  without consultation.

    • 3.4. Flowers and Non-Edible Items:

      1. 3.4.1. We only allow flowers to be added to the cake by ourselves rather than having your florist to attach them. This is to ensure that they are added in the correct food safe manner and that the placement of them matches our original design or matches our floristry style. This will be discussed during the booking process by email and/or during your consultation.

      2. 3.4.2. The costs of the flowers will be charged by your florist and it is your responsibility to make them aware that the flowers are required for the cake. We will contact your florist to arrange how much and we we need 4 weeks prior to the date as not all flowers are safe to go on a cake. We charge for our time as part of your set up fee to safely wire and wrap the flowers and arrange them on your cake.

      3. 3.4.3.If you would prefer us to provide the fresh flowers for the cake, please give us advance notice so we can add this cost to your quote. This will be a minimum of £45.

      4. 3.4.4. We reserve the right to not add specific toxic varieties of flowers to your cake if your florist has provided them for the cake. We cannot add anything to the cake which may cause an adverse reaction and it is legally the florist responsibility to make sure that the varieties provided are non-toxic. Please discuss this with your florist.

      5. 3.4.5.Most of our stacked cakes will contain non-edible elements such as plastic or wooden dowels, wired flowers or cake toppers. We will advise the staff of any non-edible elements the need to be removed during the cutting and provide written information. As we will not be cutting the cake, we cannot accept any responsibility for any non edible elements not removed prior to serving.

      3.5. Minimum Spend

  •  3.5.1 I take on a certain number of wedding cakes each week so I can give each cake the attention it needs. Therefore, I have a minimum spend of £750 and does not include delivery, set up costs, prop and stand hire. It is up to our discretion to waiver this minimum spend.

    4. Collection, Delivery and Storage

    1. 4.1.Collection: Small orders may be collected free of charge from One Part Love Bakery by prior arrangement. You agree that We accept no responsibility for any damage sustained to the cake once it has left the One Part Love Bakery premises. We advise against picking up tiered wedding or celebration cakes (see 4.2.6).

    2. 4.2.Delivery

      1. 4.2.1.Delivery Date: Subject to clause 4.4. below, We will use our reasonable endeavours to deliver the Event Cake on the date and to the address provided by the Customer in the Invoice.

      2. 4.2.2.Delivery Time: Time of performance shall not be of the essence and therefore You agree and accept that We are not liable for delivery delays. Please be aware that We do not offer specific delivery time slots.

      • 4.2.3.Delivering to your venue: When delivering to a wedding venue, We will contact the venue in advance to arrange a mutually convenient time for delivery. It is your responsibility to ensure that you have provided us with the name, address and contact details for your venue by a minimum of 2 weeks in advance of your event date.

      • 4.2.4.If One Part Love Bakery sets up your Event Cake: If we set up the Event Cake, You grant Us permission to photographs of the Event Cake before leaving your venue and, where possible, obtain a signature from the venue confirming the cake has been received in good condition.

      • 4.2.5.If your venue set up your event cake: In the event that your venue needs to set up the Event Cake themselves,  We shall explain how the Event Cake is to be displayed and where possible obtain a signature to verify we have done so. You understand and agree that once the cake has been delivered to your venue we are unable to accept and liability for any damage sustained to the cake thereafter nor any failure to follow the instructions provided.

      • 4.2.6. We do not allow for wedding cakes to be collected if they are above a single tier cake. We have the expertise and experience to know how to deliver and set them up safely to ensure no damage happens to them. Single tier cakes may be collected at a pre-arranged time.

      • 4.2.7. Delivery & Set Up Costs: delivery is worked out based on the distance in miles there and back, and the approximate time taken to set up your cake at the venue. Deliveries over 1 hours drive away will be subject to additional charge of £10 per hour (each way) to cover our time.

      • 4.2.8. Non delivery due to unforeseen circumstances: it would be very rare, but on the event day we may be faced with a force majeure e.g. severe weather conditions, public unrest, or other unexpected events out of our control. This may make delivery impossible. You can be assured we would always do our best to delivery as pre arranged, but some circumstances would be out of our reasonable control. Please ensue you have adequate wedding insurance to cover this eventuality. (Please also see 6.2.2)

  • 4.3.Storage

      • 4.3.1.Your Event cake is a fresh product containing no additives or preservatives and it is our right to assume consumption on the day requested. Event Cakes should be stored in a dry place, at room temperature, away from direct sunlight and sources of heat in the box provided. Some cakes can be refrigerated, as discussed with us.

      • 4.3.2.One Part Love Bakery and the Customer expressly agree that the Event Cakes and all goods purchased from One Part Love Bakery remain the property of One Part Love Bakery until paid for in full. You may request that your Event Cake is delivered by One Part Love Bakery, please refer to 4.2 (Delivery).

        5. Collection, Delivery and Storage

        5. Price and Payment

    • 5.1.Price: The price of your Event Cake will be detailed in your Quote. No VAT is payable on the Event Cakes.

    • 5.2.Payment Milestones

      • 5.2.1.The Customer shall pay all invoices:

        • in full in cleared funds in accordance with the payment milestones detailed in each invoice; and

        • to the bank account nominated by One Part Love Bakery.

      • 5.2.2.No further payment reminders will be sent and it is the sole responsibility of the Customer to ensure payment is on time.

    • 5.3.Late Payment

      • 5.3.1.The final balance must be paid in cleared monies no later than the date set out in the invoice by bank transfer to the account specified. Late payments will incur a £25 charge.

      • 5.3.2.If payment is not received by the date specified this shall be constituted as breach of contract by the client. We reserve the right to hold the order until payment is made in full.

      • 5.3.3.We accept no responsibility should we be unable to purchase the required stock or equipment to make the Event Cake as stated in the order confirmation due to delay causes by late payment. In these circumstances the Event Cake will be made as close to the order confirmation as possible with no redress or liability on One Part Love Bakery.

6. Cancellation, postponement and alterations:

    • 6.1.Cancellation by You

      • 6.1.1.In the event of a cancellation by the Customer, the following cancellation fees apply:

        More than ninety (90) calendar days prior to the event date = No cancellation fee.

        Ninety (90) calendar days to one month prior to the event date = 50% of the remaining balance

        Less than 1 calendar month prior to the event date = 100% of the remaining balance

      • Please note that the Booking Fee and any payments previously made are non-refundable.

    • 6.2 .Cancellation by Us

      6.2.1 In the unlikely event that We need to cancel your order any monies paid will be refunded.

      • 6.2.2 We reserve the right to cancel, vary or suspend the operation of this contract if events occur which are in the nature of force majeure including (without prejudice to the generality of the foregoing): pandemic, epidemic, government imposed travel restrictions, fire, floods, storm, plant breakdown, strike, lock outs, riot, hostilities, non-availability of materials or supplies or any other event outside the control of One Part Love Bakery, and One Part Love Bakery shall not be liable for any breach of contract resulting from such an event.

    • 6.3 Postponement

      • 6.3.1 Subject to 6.2.2, in the event that the Customer requests a postponement of their event date and One Part Love Bakery in its sole discretion agrees to accommodate such postponement, the following postponement fees apply:

  • Same calendar year and no change to venue in the original booking = No postponement fee. No delivery fee.

  • Same calendar year with change of venue to the original booking = No postponement fee. Delivery fee of 55p per extra mile.

  • Next calendar year (more than 12 months) with no change of venue from original booking = Postponement fee calculated as 10% of the original quote, which will be invoiced to the Customer and payable on agreement to move the date. No delivery fee.

  • Next calendar year (more than 12 months) with change of venue from original booking = Postponement fee calculated as 10% of the original quote, which will be invoiced to the Customer and payable on agreement to move the date. Delivery fee of 55p per mile

      • 6.3.2 In the event that a postponement is agreed between the One Part Love Bakery and the Customer, this will be treated at the new event date (the “New Date”). The New Date is subject to the cancellation policy set out in clause 6.1 above.

      • 6.3.3 If we are unable to accommodate your new date, please note the deposit is non-refundable.

  • 6.4 Amending Your Event Cake Order

      1. You may request an amendment to your Event Cake order by providing Us with a minimum of 8 weeks prior written notice.

      2. In the case of alterations a new order confirmation will be issued detailing the changes and the new cost.

      3. Alterations are not confirmed until a new order confirmation has been issued. Should you make any changes after that time there will not be a reduction in the price you pay, even if your new design is cheaper than the original booking.

      4. If you circumstances change and you wish to alter your oder after any payments have been made, then any money paid are non-refundable. This applies if the new quote is less than the amount already been paid. If the new quota is greater than the original payment amounts, then the remaining balance is due immediately.

  • 7. Allergies and Food Intolerances

    1. 7.1. Our Event Cakes are made in an environment where nuts, egg, milk, gluten and other allergens are present. We cannot guarantee that any cake is entirely allergen free but we make every effort to ensure that allergies are accommodated.

    2. 7.2. Unless otherwise stated on your invoice all cakes contain gluten, milk, eggs, soya.

    3. 7.3. We would recommend that anyone with a server allergy does not eat out cakes.

    4. 7.4. We will provide allergen information with the cake upon delivery to the venue.

    5. 7.5. One Part Love accepts no liability for customers suffering allergic reactions from eating our cakes.

  • 8. Warranties

    1. 8.1.Subject to 8.1.5 below, We warrant that:

      1. 8.1.1.the Event Cake order shall be performed in accordance with Good Industry Practice; and

    2. 8.2.the Event Cake supplied shall be free from material defects at Delivery or Collection.

  • 9. Liability

    • 9.1.Subject to 9.2. below, We shall not be liable for any failure of the Event Cake or delivery services (if applicable) to comply with the provisions of clause 8.1 where the same arises directly or indirectly and whether in whole or in part as a result of:

      • 9.1.1.a breach by the Customer of any of its obligations under this Agreement;

      • 9.1.2.an event of Force Majeure;

      • 9.1.3.any design, specification or requirement of the Customer;

      • 9.1.4.use of any  materials (including fresh flowers) supplied by the Customer; or

      • 9.1.5.from willful damage, accident, negligence by You or any third party, if you use the Event Cake in a way we do not recommend, failure to follow our instructions or any alterations You carry out.

  • 9.2.We will not be legally responsible to you for any loss or damage that is not directly caused by us, or which we could not reasonably expect at the time we entered into the Agreement with you, for example, loss of income, business, profit, savings and missed opportunities claims. We will not be legally responsible to you if we cannot provide the services because of something outside our reasonable control. Unless our negligence causes death or personal injury, there is a defect, or our services are not provided with reasonable care and skill, our liability to you will not be more than the value of the Event Cake for each claim or a series of related claims.

    10. Contacting us and Complaints.

    1. 10.1.Complaints are very rare and due to the amount of work put into each individual cake we take them very seriously. Please note we can only deal with the Customer who placed the original order.

    2. 10.2.Where the complaint is in regards to the quality of the cake then the cake, or remainder of the cake/tier, this must be returned to Us as soon as possible after cutting and within 48 hours of collection/delivery to ensure that We are able to fairly assess the nature of the complaint.

    3. 10.3.Both Parties agree to not post any negative information about the other arising out of this Contract or Event on any online forum or website without providing advance written notice of the intended content thereof, and providing the other party with a prior opportunity to resolve any issues between the parties amicably.

    4. 10.4.If you need to speak to us or have a complaint, please contact us using the contact details provided on your invoice and quote your reference number.

11.General Terms

    • 11.1.Interpretation: Any headings utilised in this Agreement have been inserted for the convenience of reference only and should in no way restrict or otherwise affect the construction of the terms and conditions hereof.

    • 11.2.Intellectual Property: All designs, photography of the Event Cake and intellectual property remain the property of One Part Love Bakery.

    • 11.3.Publicity and Advertising: We reserve the right to use images of your cake for any purpose in our sole discretion, including but not limited to: web based promotions, brochures, galleries and competitions. It is advisable that you make a copy of all documentation received from One Part Love Bakery for your own benefit. We will not use any photographs of you without your prior written consent.

    • 11.4.Variation: No variation of this Agreement shall be valid or effective unless it is in writing, refers to this Agreement and is it agreed by both You and Us.

    • 11.5.Set Off: Each party shall pay all sums that it owes to the other party under this Agreement without any set-off, counterclaim, deduction or withholding of any kind, save as may be required by law.

    • 11.6.Severance: If any provision of this Agreement (or part of any provision) is or becomes illegal, invalid or unenforceable, the legality, validity and enforceability of any other provision of this Agreement shall not be affected.

    • 11.7.Entire Agreement:  

      1. 11.7.1.This Agreement together with invoice documents provided constitute the entire agreement and understanding between the parties relating to the order. Except as may be expressly stated in this Agreement, it supersedes and cancels all prior agreements, statements, representations, understandings, negotiations and discussions, whether oral or written, between the parties.

      1. 11.7.2.Each party acknowledges and agrees that it has not entered into this Agreement or any documents entered into pursuant to it in reliance on (or has been induced to enter into this Agreement by), and shall have no remedies in respect of, any statement, representation, understanding or warranty that is not expressly set out in this Agreement or any documents entered into pursuant to it. No party shall have any claim for innocent or negligent misrepresentation on the basis of any statement in this Agreement.

    • 11.8.Governing Law & Jurisdiction: This Agreement and any dispute or claim arising out of, or in connection with, it, its subject matter or formation (including non-contractual disputes or claims) shall be governed by, and construed in accordance with, the laws of England and Wales. The parties agree to submit to the non-exclusive jurisdiction of the English courts to settle any dispute or claim arising out of, or in connection with, this Agreement, its subject matter or formation (including non-contractual disputes or claims).

We reserve the right to revise and amend these terms and conditions. However, you will only subject to the terms and conditions in force at the time you place your order with us.

1-1 CLASSES TERMS AND CONDITIONS

Please read the terms and conditions for the Bakers Cake Classes thoroughly before booking. By booking a class, the client confirms they agree to the terms and conditions below.

  1. Payment and Booking

1.1 Booking must be made via email to the Baker, in writing

1.2 Payments must be made via bank transfer once availability is confirmed by the Baker

1.3 For studio based classes a 50 % deposit is required to secure a space. The remaining 50% is due 1 calendar month prior to the class date. Failure to pay the remaining balance by the invoice due date may result in cancellation of the clients booking and all monies paid to date will be forfeited,

1.4 Spaces will not be held without a deposit

1.5 The Baker may increase or adjust prices without notice. This will not affect booking already made

2. Cancellation

2.1 If the client notifies the baker of their cancellation up to 14 days prior to the class date, a refund, minus the 50% deposit will be returned to the Client

2.2 Deposits are non refundable after the 14 day cooling off period (the client may request a refund up to 14 days from deposit payment) (See clause 2.2.3)

2.2.3 If the contract was entered (deposit received) within 28 days of the assignment date then the 14 day ‘cooling off period’ as stated in Clause 2.2 will not apply and the deposit will be non-refundable

2.3 If the client cancels within 14 days of the class date no refund will be issued and full payment will be kept by the Baker (due to loss of earnings and work carried out) unless the space is filled , in which case the Bakes may refund 50% of the class price.

2.4 If the Baker cancels the class for any reasons other than under subscription to run the class, full refunds will be issues to customers

2.5 If the Baker cancels the class due to not meeting the minimum number of participants, the client will be issued with a refund or a voucher (this is to the discretion of the baker)

3. Health and Safety and Liability

3.1 The Baker will attempts to accommodate dietary requirements where possible, however the Baker can not be held liable for any cross contamination causing health issues due to classes being held in classes that use all allergens on a regular basis.

3.2 the Customer must inform the baker of any dietary requirements prior to booking a class in order for accommodations to be made. These accommodations may incur an additional charge.

3.3 The Baker accepts no responsibility for the loss or damage of any personal property or for any liability (to the fullest extent permitted by law)

3.4 The baker is not responsible for the car parked on the driveway, the client should not bring any valuables that are liable to theft or loss during the class period.

3.5 The Baker can not be held liable for any travel or accommodation expense losses based on cancellations of the class due to unforeseen circumstances such as weather conditions and travel restrictions.

4. Attendance

4.1 Any client who is intoxicated or disruptive, abusive or violent toward the teacher, other participants of the premises will be asked to leave and issued no refund.

4.2 the Client is not permitted to bring any other individuals with them to the class unless prior arrangements with the Baker have been made

4.3 No drugs or illegal substances are allowed on the premises.
